Waiver

If I bring a dog with me to The Dog Park’s Facilities:

a) I attest that my dog:

• Is older than 4 months;

• Is current on all vaccinations. Vaccinations include Rabies, DHLPPC and Bordetella;

• Does not have fleas or ticks; and

• Is friendly and social around other people and dogs.

b) I attest that I can provide proof of vaccination, if required.

c) I attest that I am able to control my dog’s behavior and will control the dog at all times. I will prevent aggressive behavior including, but not limited to, aggressive play fighting, excessive barking and nipping. 

d) If an incident occurs between my dog and another dog or person, I agree to immediately alert an employee at the Facilities.

e) I agree to pick up my dog’s feces in all areas of the Facilities.

GUEST INFORMATION 

THIS FORM WAIVES LEGAL RIGHTS AGAINST THE DOG PARK

In consideration of access to and use of the facilities located at 1018 Walsh Rd. Madison, WI 53714, I agree to waive any right to recover damages from Boneyard Productions LLC, including all of their owners, members, managers, officers, directors, employees, agents, heirs, assigns, affiliates and related entities (herein referred collectively as, “The Dog Park”) for any harm or injuries suffered as a result of their negligent acts.  In other words, I agree to release The Dog Park for its negligent acts, even if those negligent acts cause me (or my dog) a physical injury or economic harm.  I am giving up the right to sue The Dog Park for harm caused to me (or my dog) as a result of their negligent acts. 

I hereby agree to indemnify and save and hold harmless The Dog Park from any loss, liability, damage, or cost it may incur arising out of or related to activities at the Facility whether caused by the negligence of The Dog Park or otherwise (but not including intentional or reckless acts of T he Dog Park).

This waiver does not release The Dog Park from liability for injuries resulting from any intentional acts.  

 I understand that serious risks and injuries may occur while attending The Dog Park.  Such risks and injuries include, but are not limited to: the propensity of any dog to behave in dangerous ways that may result in injury; the inexperience, negligence, or irresponsibility of a dog owner/handler; the inability to predict a dog’s reaction to movement, sounds, persons, or other animals; actions by the dog due to fright, anger, stress, or insect bites; natural reactions by the dog such as jumping, pulling, resisting, and biting; environmental and traffic conditions; acts of God; inclement weather; slips and falls; premises defects; equipment failure; failure in instruction/supervision; all other circumstances inherent to dogs and/or outdoor activities; and death.  

I understand that if I do not agree with the terms of the release stated above, I may attempt to negotiate my own terms by discussing this with an owner of The Dog Park instead of signing this form.
